
HIGHLANDER Adventure Australia – Terms of Service
Spartan AUS 3.0 Pty Ltd (trading as HIGHLANDER Adventure Australia)
Please read our transfer, withdrawal, deferral, event cancellation, and payment option policy carefully. These rules outline the conditions of registration, participation, and administration for HIGHLANDER Adventure Australia events.
1. WAIVERS
Participants must sign the event waiver applicable to their selected HIGHLANDER Adventure format before
participating. Waivers will be provided during registration and must be completed as a condition of entry.
2. AUTHORITY TO REGISTER
By completing a registration, you warrant that:

You have full legal authority to register yourself and, where applicable, any other person (“Registered Parties”).

You accept these Terms of Service on behalf of all Registered Parties.

If registering a minor or dependent, you are their parent or legal guardian and have legal authority to provide consent on their behalf.

You indemnify Spartan AUS 3.0 Pty Ltd (trading as HIGHLANDER Adventure Australia) for any loss
arising if a Registered Party later disputes your authority to register them.
3. BEHAVIOUR, SAFETY AND RIGHT TO EJECT
For the safety and enjoyment of all participants, you agree to follow all instructions from Event officials, emergency services, and land managers. You must behave safely and respectfully at all times.

HIGHLANDER Adventure Australia may, at its sole discretion, refuse entry, remove or disqualify any participant without refund where:

behaviour is unsafe, offensive or inappropriate,
-
Event rules or land-manager requirements are breached,
-
mandatory gear is not carried, or
-
safety is otherwise compromise
Your Event registration constitutes a revocable licence, and admission may be refused or revoked at any time in accordance with these Terms.
4. RISK, REMOTE-AREA CONDITIONS AND MEDICAL CONSENT
HIGHLANDER Adventure events take place in wilderness and remote environments (uncontrolled natural environments) where hazards may arise without warning and that involve significant inherent risks, including but not limited to: falls, slips, trips, unstable terrain, river crossings, steep ascents and descents, extreme weather, bushfire danger, wildlife encounters, dehydration, exhaustion, isolation, navigation errors and limited communication. You acknowledge emergency medical assistance may be delayed or unavailable due to the remote nature of the course. You accept these risks as a condition of participation.

You understand and acknowledge that participation in the Event involves risks that cannot be eliminated completely, including the risk of serious injury, permanent disability or death. By participating, you voluntarily and knowingly assume all such inherent and obvious risks, and you represent and warrant that:

you are in good physical condition and have trained appropriately for the Event,

you are capable of safely carrying all required gear and supplies,
-
you have no medical condition that would make participation unsafe, and
-
you understand and accept that you are responsible for managing your own safety and wellbeing during the Event.
You consent to receive medical treatment, evacuation or transport as deemed necessary by Event staff or emergency services, and you accept responsibility for any associated costs except where prohibited by law.
5. EQUIPMENT, SEARCHES AND PROHIBITED ITEMS
Participants must carry all mandatory gear as specified for their Event format. Event staff may conduct gear checks at any time and may refuse participation or continuation if mandatory gear is missing.
Failure to carry mandatory gear or failure to comply with gear-check requirements may result in refusal of entry, removal from the course, or disqualification without refund.
For safety reasons, Event staff may conduct bag checks at check-in or on course. Prohibited items (including firearms, weapons, illegal substances and drones) are not permitted at any HIGHLANDER Adventure event.
6. TRANSFER
If you wish to transfer your registration to another participant or transfer to another HIGHLANDER Adventure Australia event, the following rules apply.
PARTICIPANT TRANSFER
Participant transfers are permitted for individual and team registrations.
Once transferred, the new participant forfeits the right to:

A transfer fee of AUD $45 (plus any fees charged by our nominated registration platform) applies, payable by the new participant.
Transfers must be completed up to 15 days before the event start date.
Transfer requests must be submitted via the designated transfer form.

EVENT TRANSFER
Transfers are only permitted to other HIGHLANDER Adventure Australia events within the same calendar year unless by prior agreement of HIGHLANDER Adventure Australia.
Transfers to overseas HIGHLANDER events are not permitted.
A transfer fee of AUD $45 (plus platform fees) applies.
If transferring from a higher-priced to a lower-priced event, no refund of the price difference is available.
If transferring to a higher-priced event, the participant must pay the difference plus any applicable fee.
Transfers into sold-out events are not permitted.
Only individual entries are eligible for event transfer (promo or group entries excluded).
Event transfers must be requested at least 45 days prior to the original event start date.
Requests must be submitted via the designated event-transfer form.

TRANSFER PROCESS
Submit the relevant transfer form on the HIGHLANDER Adventure Australia website.
A confirmation email will be issued upon successful submission. If not received, check junk/spam or email experience@highlanderadventure.com.au.
Processing time is up to 5 business days.
Participants transferring to a different event will receive a personalised registration link to complete the new registration.
7. WITHDRAWAL
WITHDRAWAL FROM THE EVENT
Withdrawals up to 45 days before the event start date are eligible for a 50% refund.
Withdrawals within 45 days of the event start date are not eligible for refund, including for medical reasons.
Refunds will be processed to the same payment method used during registration; processing times vary.
Only individual entries are eligible for withdrawal with refund; promo and group entries are excluded.
If you do not attend the Event for any reason (‘no-show’), no refund or credit is available except as required under the Australian Consumer Law.

CHARGEBACKS
​
If refund protection is offered at checkout, it is administered by a third-party refund-protection provider.
Coverage conditions, criteria, and exclusions will be outlined in a separate policy provided by the third-party refund-protection provider.

9. DEFERRAL
DEFERRAL OPTION
Deferrals are only permitted to the same event in the following calendar year.
Applies only to individual registrations; team registrations may defer only if the entire team defers.
Once deferred, participants forfeit the right to transfer, re-transfer, refund, or further deferral.
Deferral requests must be submitted no later than 45 days before the event start date.

A new registration link will be provided when next-year registrations open.
10. PAYMENT OPTION PLAN
If available for selected events, the payment option plan operates under these rules:

Event transfers are permitted only after all instalments have been paid.
Withdrawal (50% refund up to 45 days pre-event) is only available after full payment of instalments.
The plan may only be available for selected multi-day HIGHLANDER Adventure events.
The plan applies only to individual entries.
The plan is not available for Gift Card purchases.

PROCESS
The plan must be selected during registration.
Participants may access their registration-platform profile to review status, update payment information, or pay outstanding balances.
11. EVENT FORMAT, COURSE AND START-TIME CHANGES
HIGHLANDER Adventure Australia may alter the Event start time, course route, checkpoints, distance, campsite locations or other logistics at any time for safety, weather, operational or land-manager reasons.
Where the Event proceeds in an altered format, route or distance, no refund (full or partial) is available.

HIGHLANDER Adventure Australia does not guarantee any particular start time, start group, wave assignment, campsite allocation or checkpoint schedule. These may change at any time for safety or operational reasons.
12. EVENT DATE CHANGES AND CANCELLATIONS
HIGHLANDER Adventure Australia may change the Event date where necessary for operational or safety reasons. If the Event date is changed and you are unable to attend on the revised date, you may request a deferral into another HIGHLANDER Adventure Australia Event in the same calendar year, or the same Event in the next calendar year. No refunds are available for Event date changes.
If an event is cancelled or deferred due to events beyond our control (including severe weather, natural disasters, acts of God, public emergencies, or other force-majeure circumstances), registrations will be deferred to a rescheduled date for the same event format. Refunds are not available in these circumstances.
13. INTELLECTUAL PROPERTY AND MEDIA RIGHTS
By participating in the Event, you grant Spartan AUS 3.0 Pty Ltd (trading as HIGHLANDER Adventure Australia) and its licensors (including Avantura Života d.o.o. as the HIGHLANDER Adventure franchisor) a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and distribute any photographs, video, audio or other media captured of you during the Event for promotional, commercial, editorial or internal purposes. You waive any right to inspect or approve such materials, and you agree that no compensation is payable for their use.
You must not use HIGHLANDER Adventure branding, logos or marks without prior written consent.
14. PARTICIPANT ACKNOWLEDGMENTS
By registering, you acknowledge:

That Spartan AUS 3.0 Pty Ltd (trading as HIGHLANDER Adventure Australia) reserves the right to deny entry or disqualify participants at its sole and complete discretion; maximum liability is limited to the entry fee paid.

Without prior written consent, you may not use HIGHLANDER Adventure Australia intellectual property (including HIGHLANDER Adventure brand, event logos/names, Event name/location/date/distance, or any confusingly similar marks) to sell, market, distribute or produce any products, events, merchandise, websites, or services.

HIGHLANDER Adventure Australia is not responsible for any travel, accommodation or ancillary costs incurred in connection with your participation in an Event, including where the Event is changed, rescheduled or cancelled.

Registrations may only be transferred in accordance with these Terms. Unauthorised resale, onselling, duplication, or fraudulent use of promotional codes may result in cancellation of the registration without refund.

and confirm liability for any damage (material or immaterial) or injury/death of third persons (other participants, staff, other persons) resulting from your action or inaction during participation; and for compensation of any such damage.
15. LIMITATION OF LIABILITY (AUSTRALIAN CONSUMER LAW)
Nothing in these Terms excludes, restricts or modifies any right you have under the Australian Consumer Law (ACL).
To the extent permitted by law:

HIGHLANDER Adventure Australia excludes all liability for indirect, special or consequential loss, and
-
HIGHLANDER Adventure Australia limits its total liability to the amount of the Event entry fee paid by you.
16. INDEMNITY
To the maximum extent permitted by law, you indemnify and hold harmless Spartan AUS 3.0 Pty Ltd, its officers, employees, contractors, agents and volunteers from any claim, liability, damage or expense arising from:

your participation in the Event,

your breach of these Terms, or
-
your negligent or reckless acts or omissions.
17. DISPUTE RESOLUTION
If a dispute arises out of or relates to these Terms or your participation in the Event, both parties agree to first attempt to resolve the matter through good-faith mediation before commencing legal proceedings, unless urgent interlocutory relief is required.
18. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remainder of the Terms will continue in full force and effect.
19. DATA COLLECTION AND PRIVACY
By registering for the Event, you consent to the collection, use and disclosure of your personal information for Event administration, safety, and communication purposes, in accordance with our Privacy Policy. Your information may be shared with third-party service providers, including our nominated registration platform, for operational purposes only.

Personal information collected by Highlander Adventure Australia (operated by Spartan AUS 3.0 Pty Ltd) is handled in accordance with the Spartan Australia Privacy Policy.
20. GOVERNING LAW
These Terms are governed by the laws of the Australian State or Territory in which the event is held. Each party submits to the non-exclusive jurisdiction of the courts of that State or Territory.
